1. CosMediTour Services

1.1 CosMediTour is a Medical, Weight Loss and Dental Tourism facilitator.

1.2 CosMediTour arranges submission of health and other material (provided by you) for evaluation for possible surgery or other procedures by an appropriate Surgeon or another healthcare provider, and where appropriate also arranges bookings for surgery consultations and procedures only.

1.3 CosMediTour only coordinates services and does not itself provide any surgical, medical or healthcare service.

1.4 CosMediTour does not have a financial interest in any of the Clinics or healthcare providers with whom bookings are made.

1.5 CosMediTour acts as a conduit for the provision of medical information from the Clinics and healthcare providers to you, but does not employ any surgeons or other health practitioners.

1.6 Any information provided to you by CosMediTour in relation to a proposed health or surgical procedure has been provided by the Clinics or healthcare providers that will provide the surgical procedure or healthcare.

1.7 CosMediTour provides medical information to you on behalf of the Surgeons and healthcare providers in good faith, but without offering or providing medical advice.

1.8 CosMediTour recommends that you obtain independent medical advice from a medical practitioner in relation to any surgery or other medical procedure that you might be considering or that you have asked CosMediTour to coordinate.

2. Collection of Information

2.1 CosMediTour will provide the information collected from you to the Surgeons and healthcare providers and from whom surgery or other healthcare services might be obtained for the purposes of obtaining a surgery recommendation of your suitability for, and if approved, the provision of surgery and/or healthcare procedures.

2.2 CosMediTour will not release any personal health information collected from you to any other third party without your consent.

2.3 You must provide true and complete disclosure of all health, lifestyle and other information requested by CosMediTour, or any of our Surgeons and healthcare providers. This includes information provided to CosMediTour in person, information provided by completing a CosMediTour online Assessment Form, all written and verbal communications, and all information required by any Surgeon or healthcare provider.

2.4 You must disclose, to the best of your recollection, details of all medical conditions including operations you have had, medications taken (past and current), or where you have been treated by any medical or healthcare professional including alternative therapists.

2.5 You agree to be responsible for and will agree to pay any additional costs incurred by CosMediTour and our healthcare providers due to you providing incorrect, incomplete or misleading information.

3. Process

3.1 When you make an initial enquiry, your preferred requirements are discussed with you, and CosMediTour provides information about the Surgeon, medical procedures and healthcare provider from whom services may be obtained.

3.2 CosMediTour does not guarantee your experience, nor that you will be satisfied with the surgical outcome, and CosMediTour recommends that you make your own enquiries both about the suitability of the proposed surgery and the Clinic and healthcare providers.

3.3 You must complete the online Assessment Form including providing quality photographs according to the photograph guidelines provided by CosMediTour, and if applicable, accompanying medical information.

3.4 If you have a family history of breast cancer, a Breast USS (Ultrasound Scan) will be required. However, if your medical history and background indicate that further pre-operative tests need to be done, this will be at your own cost, and your surgery price may be revised from your original quoted surgery price, or cancelled.

3.5 Following the provision of the Assessment Form and images, and any other preliminary tests required, the Surgeon or healthcare provider will provide a surgery recommendation about your suitability for the surgery procedure you have requested.

3.6 If the evaluation shows that the proposed procedure is likely to be suitable, CosMediTour will begin arrangements with the Surgeon and healthcare provider for the consultation and surgery.

3.7 Whilst in Thailand, you will attend a consultation and physical examination with the Surgeon and healthcare provider prior to surgery. At that consultation, the Surgeon or healthcare provider will give to you details of the final surgery treatment plan, any additional testing requirements if applicable, an evaluation of whether or not you should proceed with the surgery, and any other medical or health advice that the Surgeon or healthcare provider deems suitable.

3.8 If a medical condition becomes apparent on the day of or days preceding your scheduled surgery, your Surgeon will discuss this with you, and your surgery will be rescheduled at the sole discretion of your Surgeon.

3.9 All smokers who have not ceased smoking, a minimum of 6 weeks prior to surgery, are considered high-risk patients and surgery may be postponed or cancelled by the Surgeon or healthcare provider. In such cases, full Cancellation penalties will apply.

3.10 The Surgeon and healthcare provider at all times reserves the right to refuse to carry out a procedure for any reason.

3.11 If you decide to proceed following the consultation and examination, after having received details of the final surgery treatment plan and costs, the surgery will proceed on the scheduled surgery date.

3.12 Unless instructed by your healthcare practitioner you must cease taking prescribed medications and all-over-the-counter medications, vitamins, and supplements, at least 2 weeks prior to surgery.

3.13 You must inform CosMediTour if you become ill within 4 weeks of surgery, and supply all details including medication and dosages. You must inform CosMediTour if there has been a change in your weight over 3kg.

3.14 You acknowledge that all individuals have different post-surgery recovery rates, results and reactions to anaesthesia, pain medication, antibiotics and other medications and treatments.

3.15 You acknowledge that each surgical procedure carries risk and that there is an expected recovery period of up to 6 months from surgery procedures during which time all care must be taken with lifestyle and activity levels, so as not to compromise the eventual surgery and aesthetic outcome.

3.16 You acknowledge that if a problem arises post-surgery or if you have other concerns during the initial 6 month recovery period, you are required to inform CosMediTour of all details, for review and communication. On a case-by-case basis, any post-surgery problem will be sent to and reviewed by the Surgeon. You may be required to return to the Thailand hospital for surgery and treatment in a time frame determined by the Surgeon. Costs will also be determined by the Surgeon and healthcare provider.

3.17 If there are any complications, infections, or unexpected outcomes you are not satisfied with post-surgery, whilst still in Thailand, you must advise our local Thailand personnel who will liaise with your Surgeon and healthcare provider.

3.18 If there are any complications, infections, or unexpected outcomes post-surgery upon return home, you must advise a medical practitioner or healthcare provider directly, and then contact your CosMediTour Client Manager.

3.19 Clients under 20 years of age, are required to complete Parental/Guardian Consent forms, with accompanying Passport identification and a letter of consent from Parent/Guardian. This person must also be advised of all proposed and scheduled Surgery arrangements.

4. Payment Obligations

4.1 Prices for packages or procedures listed on the CosMediTour website and other marketing channels as well as discussions that CosMediTour has with you during initial enquiries or consultations are indicative of surgical and package from prices only andare quoted in Australian Dollars (or other currencies), and are determined based on prices in Thai Baht (THB). These prices are current at the time of publication and subject to change.

4.2 Whilst every effort is made in the assessment of your medical and other information and images provided to determine a final cost prior to arrival in Thailand, the final cost of any intended procedure will be confirmed at the time of your in-person consultation and physical examination by the Surgeon.

4.3 A surgery Deposit is required to book a surgery date and place on a list of surgery patients with an agreed Surgeon, a healthcare provider, or to secure a promoted surgery procedure or surgery package price. The balance of the estimated price is payable 45 days prior to surgery unless a surgery date is confirmed within 45 days, in which case the balance is payable when invoiced.

4.4 A surgery Deposit is non-refundable for change of mind or cancellation. The deposit may be applied as a once-off contribution towards a surgery or dental procedure valued greater than $6,990 booked through CosMediTour with a procedure date within 12 months of the invoice issue date.

4.5 By paying the surgery Deposit Invoice you are agreeing to the CosMediTour Amendment & Cancellation Policy on the CosMediTour website.

4.6 As the in-person consultation and physical examination with your Surgeon will usually occur in the day preceding your surgery or on the day of your surgery, you must pay any adjustment, if applicable, between the estimated price prepaid to CosMediTour and the final price as agreed with the Surgeon, prior to your surgery.

4.7 The surgery procedure and package prices do not include the costs of any additional tests that may be required prior to your surgery if determined by your Surgeon or healthcare provider. You must pay extra costs to whoever is conducting the tests, or to the healthcare provider.

4.8 You acknowledge that the surgery procedure or package prices do NOT include the costs of any post-operative surgery or other treatment that may be required due to unexpected outcomes, complications, infections or otherwise. It will also not cover some treatments or corrective surgery in circumstances where the Surgery Travel Back Warranty is not purchased. In those cases, fees will be payable by you to the Surgeon or healthcare provider (or your own medical practitioner) for any required postoperative surgery, or other treatment. In addition, you must pay the cost of any flights, hotel and other travel costs required to travel to the healthcare provider relating to any additional required treatment.

4.9 CosMediTour offers a Surgery Travel Back Warranty. Depending on your surgery procedure booked, the Warranty premiums vary depending on the procedure or combination of procedures. The Surgery Travel Back Warranty can be added to your invoice in advance of your travel to Thailand. Note: The Travel Back Warranty is a CosMediTour product, Not a Travel Insurance Policy.

4.10 Your Final invoice issued by CosMediTour is payable in full to CosMediTour 45 days (6 weeks) before your scheduled surgery. If payment is not received within this period, your surgery date will be subject to cancellation. Funds will be sent directly to the Surgeon, healthcare provider, hotel and other suppliers, via ITT (International Bank Transfer).

5. Medical Acknowledgements

5.1 You acknowledge that you may withdraw from surgery at any time prior to the surgery taking place if you are not entirely comfortable with the final surgery treatment plan. The CosMediTour Amendment & Cancellation Policy applies.

5.2 The Surgeon and healthcare provider will require you to complete additional paperwork, sign consents and other documents in relation to all aspects of the surgery and treatment.

5.3 Any decision about whether additional treatment or procedures are required will be solely determined by the Surgeon and/or healthcare provider.

5.4 Whether or not you are well enough to undertake surgery, or have recently been exposed to a condition which makes surgery unsuitable or requires surgery to be postponed, is at the discretion of the Surgeon and the healthcare provider.

5.5 You agree that CosMediTour is not liable for the provision of, or the outcomes of, any surgery or health procedure or your overall experience during your surgery, associated surgery recovery or travel. If a Weight Loss Surgery client, you understand that CosMediTour does not guarantee weight loss results.

5.6 You agree to release (and by signing these Terms and Conditions do release) CosMediTour from all responsibility for health and surgery matters, including information provided to you about those health and surgery matters, and acknowledge these are the responsibility of the Surgeon and healthcare provider.

5.7 You understand that all surgical procedures carry risks. You agree that you have read and understood the Recovery and Risks for Plastic Surgery or Weight Loss Surgery.

6. Other Items

6.1 Once CosMediTour has confirmed and coordinated a surgery procedure and consultation with you, the Surgeon and healthcare provider will provide a surgery treatment confirmation schedule containing dates, bookings and other information relating to your surgery. Accommodation will also be confirmed.

6.2 All information from CosMediTour is sent electronically (via email) only. It is important that you keep a reference to these details in your email.

6.3 Surgeons are required at times to travel away for emergencies or other reasons or may become unwell. If this is the case at the time of your confirmed booking, your case will be handed over to another fellow Surgeon who will perform surgery. CosMediTour will only assign your case to another Surgeon if that Surgeon is known to CosMediTour and can perform surgery at the appropriate level of skill and competency in line with industry-accepted surgery outcomes for your particular case and procedure.

6.4 Where any promotional offers or vouchers have been obtained from a CosMediTour competition or affiliate, you must adhere to the Terms and Conditions of the promotional offer or voucher.

6.5 It is your responsibility to read and understand the Terms and Conditions of all flight and accommodation reservations made by yourself, a travel agent or CosMediTour on your behalf, as amendments, cancellations or no-shows will incur fees.

6.6 CosMediTour strongly recommends that you obtain InternationalTravel Insurance at the time of booking accommodation and flights, or purchase a ‘Flexi Fare’ flight that allows you to amend your flight itinerary with minimal fees.

6.7 Costs, booking Terms and Conditions for accommodation options that may be promoted by CosMediTour will vary depending on the property, accommodation type, and travel dates.

6.8 Hospital transfers are offered to Inpatient clients only.

6.9 You acknowledge that it is your responsibility to be informed about current travel advice, protocols and warnings between your home country and Thailand. This includes understanding any risks, travel restrictions, entry conditions, and importantly, planning for your personal safety in relation to COVID-19 and other.

7. Disclaimer

7.1 Website Material* is derived from a variety of sources and as such, CosMediTour is not responsible or liable for any inaccuracies or omissions as a result of information received from third parties. CosMediTour does not advocate any specific technique or philosophy of cosmetic or other surgery procedures, nor does it endorse any medical procedure whatsoever. CosMediTour does not warrant that the information or material on this website is entirely free from errors or omissions.

7.2 Liability* CosMediTour does not guarantee the outcome or any results of any Client Surgery or other procedure performed by a Surgeon or healthcare provider. CosMediTour is a “facilitator and organiser” only, assisting Clients after they have chosen and confirmed to proceed with surgery, by organising arrangements for surgery, dates, travel and accommodation only. CosMediTour does not accept any liability in contract or in tort for any miscommunication, misunderstanding, injury, surgery and other procedure outcomes, damage, communication delays, loss, delay, additional expenses incurred or inconvenience caused directly or indirectly by force majeure, unanticipated or uncontrollable event or effect on our part or directly or indirectly in connection with any surgery and associated travel organised by CosMediTour on the Client’s behalf. The Client agrees to release, defend and hold harmless CosMediTour and its officers, employees and agents from any and all such liability and indemnify each of them and CosMediTour severally against any claims that may be made by or on behalf of the Client related to entering into any Agreement with CosMediTour and/or any use of its Website, Instagram or Facebook pages in any manner.
