Terms & Conditions

CosMediTour (Consulting) Pty Ltd (“CosMediTour”) ACN 115 250 452 of 9 Ouyan St, Bundall, Queensland, Australia, and “the Client” accept the Terms and Conditions as follows:

1. CosMediTour Services (FACILITATOR ONLY)

1.1 Nature of Service: You expressly acknowledge that CosMediTour operates strictly as a Specialised Booking Facilitator, analogous to a travel agent. Our role is limited to administrative coordination: securing appointments, forwarding medical data, and booking accommodation/transfers.

1.2 No Medical Services: CosMediTour does not provide medical advice, employ any surgeons, and does not hold a financial interest in any clinic. The "End Destination" (Hospital/Surgeon) is solely responsible for clinical outcomes.

1.3 Exclusions: Unless explicitly stated, our services do not include international airfares or travel insurance.

1.4 Independent Advice: We recommend you obtain independent medical advice from a qualified specialist regarding your proposed procedure.

2. Collection of Information

2.1 Data Transfer: You authorise CosMediTour to transfer your health information to Surgeons/Healthcare Providers for the purpose of obtaining a suitability assessment.

2.2 Full Disclosure: You must provide true, complete disclosure of all health conditions, medications (past/current), and lifestyle factors. You accept financial liability for any costs or cancellations arising from incorrect, incomplete, or misleading information provided to us.

2.3 Privacy: We will not release your health information to third parties without consent.

2.4 Third-Party Comms & Payments:

(a) We will not discuss your file with family/friends without your explicit written authorisation.
(b) Third-party credit card payments require a signed Credit Card Authorisation Form and ID verification.

3. MEDICAL PROCESS & CLIENT RESPONSIBILITIES

3.1 Assessments & Scheduling: CosMediTour provides surgeon recommendations based on your enquiry. You acknowledge that surgery dates are not guaranteed until confirmed in writing and that overseas scheduling requires flexibility.

3.2 Breast Screening: It is a mandatory condition that all breast surgery patients obtain a current Breast Ultrasound (USS) or Mammogram in their home country prior to travel. Failure to provide this may require expensive testing in Thailand or cancellation of surgery at your cost.

3.3 Tests in Thailand: You will undergo mandatory pre-surgery tests (Blood, X-Ray, ECG) in Thailand. If medical conditions are detected, the Surgeon may reschedule or cancel your surgery.

3.4 The Consultation: You will have a face-to-face consultation with the Surgeon to discuss the final plan. You retain the right to proceed or withdraw based on this discussion.

3.5 Lifestyle Risks: Smokers (who have not quit 6 weeks prior) and patients with undisclosed weight changes (>5kg) or illness risk cancellation with full penalties.

3.6 Activity Restrictions (Shopping & Tourism): You acknowledge that during recovery, strict care must be taken. You agree to avoid shopping, tourist activities, and excessive movement in Thailand after surgery to prevent compromising the aesthetic outcome.

3.7 Clinical Jurisdiction: From admission to discharge, you are under the sole clinical care of the Hospital, NOT CosMediTour. We are not liable for post-surgery complications, including, without limitation, haematomas, necrosis, and infections.

3.8 On-ground Complications & Fit to Fly: If you experience complications (e.g., infection) whilst in Thailand:

(a) Notification: You must immediately advise our local Client Liaison.
(b) No Departure: You must not depart Thailand until you receive a 'Fit to Fly' certificate from your Surgeon.
(c) Departure Against Advice: If you leave without clearance, you do so at your own risk. You expressly release CosMediTour from all liability for deterioration (e.g., sepsis) caused by travel.
(d) No Compensation: CosMediTour is not liable to pay compensation or reimbursement for extended stays or medical costs resulting from such decisions (refer to Clause 4.4).

3.9 Complaints upon return home (condition precedent) If there are complications upon your return home, you must:

(a) Seek immediate local medical attention; and
(b) Explicitly "Request a Case Review" by providing CosMediTour with current high-res photos and a medical report diagnosing the issue.
CosMediTour cannot escalate a complaint or activate any warranty without this objective evidence. You agree that CosMediTour is NOT liable for the occurrence of the medical complication itself (refer to Clause 4.4).

4. PAYMENT & FINANCIAL LIABILITY

4.1 Pricing: All quoted prices are indicative "from" prices in AUD and subject to change until the final in-person consultation.

4.2 Deposits: Surgery deposits are non-refundable but may be held as credit for 12 months. Balance is payable 45 days prior to surgery.

4.3 Warranty: CosMediTour offers an optional 'Surgery Travel Back Warranty'. This is NOT a travel insurance policy. Terms apply.

4.4 Universal Liability for Additional Costs (The "No Compensation" Clause): You expressly acknowledge that the package price covers standard inclusions only.

(a) Sole Responsibility: CosMediTour is NOT liable to pay, refund, compensate, or reimburse you for any additional costs incurred before, during, or after your surgery, regardless of the cause.
(b) Client Liability: You are solely financially responsible for:

(i) Medical: Additional pre-op tests, hospital stays, or medications, revision surgery, or treatment for complications.
(ii) Travel: Flight changes, new tickets, extended accommodation, or lost income.

(c) Contingency: You must possess access to emergency funds to cover these potential costs.

5. LIABILITY RELEASE & ACKNOWLEDGEMENTS

5.1 Release: You agree that CosMediTour is not liable for the outcomes of any surgery, your overall experience, or complications arising from failure to adhere to Clause 3.6 (Activity Restrictions).

5.2 Risk: You acknowledge the inherent risks of surgery. By signing these Terms, you release CosMediTour from responsibility for health/surgery matters, acknowledging these are the sole responsibility of the Surgeon.

6. Other Items

6.1 Logistics: It is your responsibility to read all flight/accommodation terms. We strongly recommend International Travel Insurance.

6.2 Surgeon Availability: If your Surgeon becomes unavailable (illness/emergency), we will assign a similarly qualified Surgeon.

6.3 Force Majeure & Travel Bans: If surgery cannot proceed due to a Force Majeure Event (e.g., pandemics, border closures):

(a) CosMediTour will not issue cash refunds.
(b) Funds (excluding third-party disbursements) will be converted into a Future Surgery Credit valid for 24 months.

6.4 Language: You acknowledge that Thailand is a foreign medical environment. English is a secondary language. You agree to seek clarification if you do not understand an instruction.

6.5 Social Media & Disputes: You agree to engage with our internal dispute process (Clause 3.9) before publishing reviews. You agree not to publish defamatory statements or accuse CosMediTour of medical negligence.

6.6 Client Conduct & Termination: You agree that all communication with CosMediTour staff will remain respectful and solution-focused. If expectations remain misaligned or communication becomes disrespectful, CosMediTour reserves the right to cease facilitating your booking and cancel your file in line with our Cancellation Policy.

6.7 Accompanying Minors: It is a strict policy that clients must not travel with minors (under 18) unless accompanied by a separate, capable adult guardian.

(a) Supervision: You acknowledge that neither CosMediTour staff nor Hospital staff are responsible for the supervision or care of minors.
(b) Restrictions: Minors must not be left unattended in hotel rooms or hospital waiting areas while you are in surgery or recovery. Failure to secure an appropriate guardian may result in cancellation of your surgery.

7.2 General Liability: CosMediTour does not guarantee surgical results. As a facilitator, we accept no liability in contract or tort for injury, surgery outcomes, delays, or additional expenses. You agree to indemnify and hold harmless CosMediTour and its officers against any claims related to your booking.

8.2 The Client submits to the exclusive jurisdiction of the courts of Queensland and the Federal courts of Australia sitting in Queensland for any dispute.
